REACH: Appeal against ECJ judgment on titanium dioxide

On November 23, 2022, the European Court of Justice (ECJ) declared the classification of titanium dioxide in powder form as carcinogenic cat. 2 by inhalation to be void.

Both the European Commission and France have now appealed against this judgement. The French Ministry of the Environment justified this approach in its announcement with the fact that the European Court made its own assessment and interpretation of scientific data in the court ruling. According to the French authorities, the European Court has thus exceeded its judicial control.

The appeal procedure is conducted at the ECJ. The procedure can be expected to last at least 1-2 years. The classification will remain in effect until the end of this process.
